Yes, Illinois was the 20 th state to legalize CBD in the state, by implementing the medical marijuana program under the Industrial Hemp Act .
What’s Legal, What’s Not!
CBD products (including CBD Oil) containing less than 0.3% of THC is allowed in Illinois.
However, if the percentage of THC extends 0.3%, it might be considered illegal. CBD derived from hemp contains less than 0.3% THC, and is therefore legal. However, CBD derived from Marijuana usually contains more than 0.3% THC, and its use is therefore illegal in the state.
In addition to CBD, the state also allows possession of small amounts of marijuana but the term ‘small’ is not quantified.
The confusion however starts with the DEA listing hemp as well as marijuana as Schedule I drugs, which is the same category as heroin or ecstasy but the 2018 Farm Bill has legalized industrial hemp all over the country.
The Illinois Cannabis Control Act in 2014 through the hemp research pilot program allowed various higher educational institutes and research institutes to cultivate industrial hemp for research purposes only.
But in 2018, the SB-2298 or the Industrial Hemp Act Illinois got overwhelming support from both the House and the Senate and is now awaiting the Governor’s approval. This amends both the Cannabis Control Act and the Noxious Weed Act to remove hemp from their categories.
Illinois has legalized the use of marijuana-based CBD for medical purposes only with signing a bill that legalizes industrial hemp cultivation across the state of Illinois and also established various rules to test THC levels. This bill directs that the CBD from hemp based products should contain no more than 0.3% THC.
